TERMS AND CONDITIONS FOR 'USERS' OF NOBUY RENT

This website www.nobuyrent.com (“Website”) and its mobile application “NOBUY RENT” (“Mobile Application”) are owned by Atozrent Private Limited, a company incorporated under the Companies Act, 2013 with its registered office at D. no. 21, 21/1, Second Street, Sankara Nagar, Vilankurichi, Coimbatore North, Coimbatore, Tamil Nadu, India - 641035, The Company operating under the brand name, NOBUY RENT.

Your access and use of the NOBUY RENT, its services and tools are governed by the following terms and conditions Terms including any applicable policies, rules, code, conditions and guidelines of NOBUY RENT “NOBUY RENT Policies” which are incorporated herein by way of reference and/or which may be issued by NOBUY RENT from time to time, with or without prior notification. By mere use of the NOBUY RENT, You are agreeing to comply with and be bound by the following Terms.

For the purpose of these Terms, wherever the context so requires "You" or "User(s)" shall mean any natural or legal person who visits, accesses, browses or uses NOBUY RENT for availing its Services and indicate “Receiver(s)” as specified in the Website and Mobile Application. The term "We", "Us", "Our", “Company” shall mean NOBUY RENT, and/or its assignees, employees and authorised representatives.

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

These Terms are published in compliance with and are governed by the provisions of Indian law (as amended from time to time), including:

the Indian Contract Act, 1872;
the (Indian) Information Technology Act, 2000 and the rules, regulations, guidelines and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011; and
The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021,
Personal Data Protection Act, 2023

And rules and guidelines framed thereunder, and other applicable laws. It is mandatory for You to Sign Up and register Yourself with NOBUY RENT as detailed hereunder to gain access to Our contents. When You use NOBUY RENT, You will be subject to the NOBUY RENT Policies applicable to any service, and they shall be deemed to be incorporated into the Terms and shall be considered as part and parcel of the Terms. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms, at any time without any prior written notice to You. The changes or any modifications will be intimated to You within thirty (30) days of its updation and it is Your responsibility to review these Terms periodically for updates / changes. Your continued use of the NOBUY RENT following the posting of changes will mean that You accept and agree to the revisions. Definitions and references that form a part of NOBUY RENT Policies shall be referred to as part of these Terms wherever the context requires.

ACCESSING, BROWSING, DOWNLOADING OR OTHERWISE USING NOBUY RENT INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS, SO PLEASE READ THE TERMS CAREFULLY BEFORE PROCEEDING.

1. Representation and Warranties:
By accessing or using NOBUY RENT, You represent and warrant that:
1. You are either at least 18 years old or You are using NOBUY RENT under parental/legal guardian’s guidance and consent, at all times;
2. You have the lawful authority and capacity to contract and be bound by these Terms;
3. If You are accepting these Terms on behalf of a company, limited liability partnership or any other legal “Entity”, You have the authority to bind such Entity to these Terms and, in such an event, “You” and “Your” as used in these Terms and Conditions shall refer to such Entity
4. You agree to adhere to the laws, rules, Regulations, Circulars, Notifications, Guidelines, By-laws and Policies issued by authorities that are/may be applicable to You including but not limited to the laws of India, for the time being in force “Laws”, at all times;
5. You agree that NOBUY RENT is a local discovery platform providing products/properties for rent and services for hire that are available in and around Your location (“Services”) and providing a marketplace where Vendors providing such products and services for rent/hire, properties for rent meet. (“Vendors”). The term “Vendor” refers to “Owner(s)” as indicated in the Website and Mobile Application. (Any reference to “product or services” in the context of products/services listed on NOBUY RENT, shall also include properties or any other matters listed on NOBUY RENT).
6. NOBUY RENT reserves the right to terminate Your account created on NOBUY RENT and/or refuse to provide You with access to NOBUY RENT if it is brought to NOBUY RENT’s notice or if it is discovered that You are not eligible to use NOBUY RENT, or if You have acted in contravention of these Terms.
2. Access and Use
NOBUY RENT grants You a limited, personal, non-exclusive, non-transferrable and non-sublicensable right and access to use NOBUY RENT, subject to the Terms and the following representations and warranties:
1. You shall only access NOBUY RENT using authorized and lawful means;
2. NOBUY RENT shall not be liable for any failure or default to provide access to the NOBUY RENT on account of any failure or delay by You to register or subscribe with the NOBUY RENT as the case may be for such access;
3. Any configuration or set up of the Devices for access to the NOBUY RENT shall be Your sole responsibility. “Device(s)” means a device, usually electronic, that processes data according to a set of instructions, which may include but not limited to workstations, personal computers, laptops, netbooks, personal digital assistants, tablets, and smartphones;
4. We collect, store, process and use Your information in accordance with Company’s Privacy Policy. By using NOBUY RENT and/ or by providing Your Personal Information (as defined in the Privacy Policy), You consent to the collection and use of the information You disclose to Us, in accordance with the Privacy Policy;
5. NOBUY RENT displays the list of products and services, featured/promoted products/services, suggested products/services available at specific locations for any casual visitor of the website or mobile application. Such casual visitors are equally bound by the applicable Laws, general obligations towards data privacy and protection, and NOBUY RENT Policies as the case may be.
6. The Services of NOBUY RENT may be accessed and utilised by signing up using Your mobile number and by providing all the other details necessitated by NOBUY RENT. “Sign Up”. A One Time Password (OTP) will be sent to Your registered mobile number via SMS, which will be required to be entered to Sign Up on NOBUY RENT. After Signing Up with NOBUY RENT and registering the necessitated details, You can log in and access Your profile/account “Account” using the login credentials.
7. You may login to Your account to access the contents of NOBUY RENT, through the following means:
  1. OTP verification through SMS or
  2. Gmail or through other applications/platforms, or in any other mode as permitted by NOBUY RENT.
8. You are solely responsible to keep Your login credentials and accessibility to Your Account, including but not limited to Your e-mail id, Your passwords, access to Your Devices etc., secure; You shall immediately notify NOBUY RENT of any actual or suspected or unauthorised use or access of Your Account by any other User or Vendor or any third parties. Although NOBUY RENT shall not be liable for any of the consequential losses caused by any unauthorised use of Your Account, You may be held liable for the damage or loss caused to NOBUY RENT or to its Users or Vendors or any third parties as the case may be, due to any unauthorised use of Your Account.
9. You shall upload Your true and accurate profile information in Your Account, to enable interaction with You on NOBUY RENT and for NOBUY RENT to provide effective services to its Users and Vendors. However, in respect of modification or change or update of information that You wish to make in Your Account, NOBUY RENT reserves its rights to verify, refuse or allow such modification or change or updation upon verification or authentication.
10. NOBUY RENT shall not be liable for any fake, inactive, innaccurate, fraudulent, misleading, impersonating, non-existing Accounts created by Users or Vendors.
11. You shall not knowingly include or use any false, inaccurate, incomplete, disintegrated or prohibited information while using NOBUY RENT; You shall not take any action that interferes with, degrades or adversely affects the Services and reputation of NOBUY RENT;
12. You shall not use NOBUY RENT in a manner
  1. that is prohibited by any law or regulation, or facilitates the violationof any law or regulation; or
  2. that shall disrupt the usage of NOBUY RENT by any other Vendors or Users
  3. that violates or tampers or reasonably appears to violate or tamper with the programmed functioning and security of NOBUY RENT;
13. You shall not use NOBUY RENT, for other purposes including but not limited to transmit, publish, post, upload, distribute or disseminate any inappropriate, harassing, abusive, defamatory, libellous, obscene, illegal, seditious, provocative or deceptive content as opposed to the applicable Laws;
14. You shall not copy, modify, adapt, translate, store, transmit, publish, distribute, disseminate, or reverse engineer the information or the content available in NOBUY RENT, without specific written authorization from NOBUY RENT, that otherwise violates and infringes the rights of NOBUY RENT in any manner whatsoever, in accordance with the applicable laws;
15. You shall ensure that NOBUY RENT is not used to upload, post, transmit, or otherwise make available any content that contains a virus or any other form of malicious code or data that is likely or intended to have an adverse impact on NOBUY RENT or any other software, hardware, services or data in and of NOBUY RENT or provide unauthorized access of NOBUY RENT, to Yourself or any other Vendors or Users or any third parties;
16. You shall not attempt to gain unauthorised access to any accounts, computer systems or networks connected to NOBUY RENT, through hacking, or any other means, or obtain or attempt to obtain any materials or information through any means not intentionally made available to You;
17. You shall not copy, modify, adapt, translate, or reverse engineer any portion of the NOBUY RENT, its contents or materials and/or the services. You shall not access or use NOBUY RENT to develop, or to assist anyone in developing competitive and/or similar services provided by NOBUY RENT;
18. You are prohibited from endorsing, publishing, soliciting, promoting, sharing, distributing, transmitting any posts, hyperlinks, invitations, offers, in any form, whether directly or indirectly, to the Users or other Vendors for any other purpose, inside or outside NOBUY RENT, including but not limited to
  1. Any unsolicited communications, messages, information for the purpose of collecting or disseminating information from/amongst the Users or Vendors etc.,
  2. Information that belongs to another person and to which You not have any right;
  3. Information relating to providing job opportunities; or
  4. hosting/promoting/sharing information about or hyperlinks to any third party applications, softwares or events in NOBUY RENT; or
  5. hosting/promoting/sharing information about any product or service provided by any third parties or Users or Vendors
  6. sharing of information that is sexual, racist, discriminatory, or relate to prostitution, child/women trafficking, drug abuse and anything prohibited by law; or
  7. sharing of information that are prohibited and are punishable under Indian Penal Code, 1860 or any other law for the time being in force; or
  8. Promotion of political party(ies), their agendas, their idealogies; or
  9. Promotion of any religion(s), religious sentiments, practices and activities
  10. Sharing Harmful Code (as defined under these Terms) to access, collect, copy, deciper, use, alter, transform, duplicate, modify, process, decompile, disassemble, frame, hot link, deep link or reverse engineer any information of the User or Vendor or NOBUY RENT, irrespective of the nature of the information and the purpose, affecting the rights or interests or security or privacy or reputation of the Users or of the Vendors or of NOBUY RENT, whether directly or indirectly;
  11. Sharing information that is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
  12. Information that is harmful to children;
  13. Information that impersonates another person;
  14. Information that is in the nature of an online game that is not verified as a permissible online game;
  15. Information that is in the nature of advertisement or surrogate advertisement or promotion of an online game that is not a permissible online game, or of any online gaming intermediary offering such an online game;
  16. sharing of information that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation;
  17. And sharing any other information, documents, materials, contents that are unlawful, illegal, harmful, misleading, misrepresentative, infringing the rights including intellectual property rights and against the interests of other Users or Vendors or NOBUY RENT.
  18. Information that violates any law for the time being in force;
  19. And anything contrary to Section 3(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
19. NOBUY RENT is committed towards creating a safe and secure environment for Users and Vendors, free from harassment of any kind (sexual or otherwise), unlawful discrimination, intimidation, etc., and you agree and acknowledge that no such unlawful activity shall be undertaken by You while availing the Services. Any such unlawful activity may be reported by You by reaching out to support@nobuyrent.com. However, you acknowledge and agree that NOBUY RENT is not the designated or appropriate authority to pursue any legal action in such matters. You also acknowledge and agree that any claims/actions against other Users or Vendors regarding the same may be pursued and remedied before appropriate legal authorities. NOBUY RENT specifically disclaims all or any liability relating to the same.
20. You shall be solely responsible for
  1. procuring and maintaining Your network connections and telecommunications links from Your systems to the Company’s data centres and
  2. all problems, conditions, delays, delivery failures and all other loss or damage arising from or relating to Your network connections or telecommunications links or caused by the internet;
21. You acknowledge that from time to time, NOBUY RENT may at its sole discretion, introduce, insert, modify, alter, delete, post, update any data, information, services, contents, algorithm, features, facilities and/or any other information in NOBUY RENT, whether for the purpose of fixing an error, bug or other issue in the NOBUY RENT or enhancing the functionality of NOBUY RENT “Upgrades” and that such Upgrades may result in changes in the contents, appearance and/or functionality of NOBUY RENT. You may be required to install some of the Upgrades to NOBUY RENT in Your Device(s) in order to continue to access or use NOBUY RENT, or portions thereof.
22. NOBUY RENT has absolute rights over the contents and information You share or post or publish or disseminate or distribute in NOBUY RENT though it does not and cannot review every such content or information made on NOBUY RENT. These Terms do not require NOBUY RENT to monitor, police or remove any postings or other information submitted by any Vendor or User and NOBUY RENT shall not be responsible for any ensuing liability. However, You acknowledge that NOBUY RENT may exercise its editorial/censorship rights over any posts, content or information shared by You, if the same are not consistent with these Terms and/or Privacy Policy and/or any other NOBUY RENT Policies.
23. NOBUY RENT shall not be responsible in any manner for the authenticity of the personal information or sensitive personal data or information supplied by the User to Vendors or NOBUY RENT or to any other person acting on behalf of NOBUY RENT.
24. You hereby agree to cooperate with NOBUY RENT, at all times, for the purpose of providing/sharing any information, feedback, data, materials etc., for the purpose of providing ethical, effective and uninterrupted Services on NOBUY RENT.
25. You hereby consent and authorise NOBUY RENT to record, study, process, compile, disclose and share any necessary and relevant data to third parties or on social media, pertaining to the Users’ preferences, and/or feedback/listings, for the purpose of facilitating ethical, effective and uninterrupted Services in NOBUY RENT.
26. We may at any time cease providing any or all of the Services at Our sole discretion and without notice.
27. You are prohibited from using any engine, software, tool, agent or any device or mechanism (such as spiders, robots, avatars or intelligent agents) to navigate or search NOBUY RENT;
28. You agree that NOBUY RENT may contact You through telephone, email, SMS, or any other electronic means of communication for the purpose of:
  1. Obtaining feedback in relation to website or NOBUY RENT’s services; and/or
  2. Obtaining feedback in relation to any Users/Vendors listed or to be listed on the NOBUY RENT; and/or
  3. Resolving any complaints, information, or queries raised by You, Vendors or other Users etc.
  4. And for any other purpose in order to provide efficient and effective services to the You, other Users and Vendors
  And You agree to provide Your fullest co-operation to further such communication by NOBUY RENT, subject to these Terms.
29. All communications transmitted through NOBUY RENT, including without limitation to Our messaging services and calls as may be permitted by NOBUY RENT may be monitored and stored by NOBUY RENT for quality assurance, training and other purposes. By accepting these Terms, You consent to any such monitoring and storage.
30. NOBUY RENT follows a strict confidentiality policy and You shall not directly or indirectly make use of or divulge, any information that is not in the public domain and intellectual property rights whether registered or not, relating to NOBUY RENT or its Users or its Vendors its personnel or its associates or its affiliates or its clients (including but not limited to logos, trademarks, know-how, patents, copyrights, trade secrets, design rights, rights relating to computer software, data, inventions, discoveries, source codes, designs, software programs, applications, database, flowcharts, depictions, summaries, materials, documentation, records, forms, compilations, executables, binaries, discussion notes, health records, messages, chats, medical prescriptions, diagnosis reports, therapy notes and any other industrial or intellectual property rights) to any person, without specific authorization from NOBUY RENT at all times.
31. NOBUY RENT may facilitate interaction between the User and Vendor, through emails, messages or calls or in any other mode; NOBUY RENT does not store or intercept such calls or communications. The phone call option facilitated by NOBUY RENT shall be based on a phone carrier that is synced with Your Device. You agree and acknowledge that You shall not involve in any prohibited or unlawful activity during such calls and communications. Any claims/actions against other Users or Vendors regarding any unlawful or prohibited activities may be pursued before appropriate legal authorities; NOBUY RENT shall not be liable for any damages suffered by You as a result of such unlawful or prohibited activities by other Users or Vendors.
32. You acknowledge that these Terms, the Privacy Policy and NOBUY RENT Policies, in addition to or in modification of these Terms, with all the amendments or modifications or Upgrades, shall bind You under all circumstances, without any further notice.
33. By accepting these Terms, You unequivocally agree not to act against the interests and reputation of NOBUY RENT, in any manner whatsoever.
3. Mode of Operation:
1. The Services of NOBUY RENT can be accessed by You, by registering on NOBUY RENT through Your phone number, e-mail, or other means, thereby creating Your Account. After creating Your Account, You will be directed to the home page of the application where a list of the Services available will be displayed.
2. Upon creating Your Account, NOBUY RENT may facilitate better Services for Users, in case of You setting up Your profile with necessary details, including but not limited to Your Name, Gender, Age, Date of Birth, Address, Address proof, ID Proof, WhatsApp Number, Mobile Number, E-mail, Occupation, Education, Interests, as required/mandated by NOBUY RENT “Profile”. After setting up Your Profile, You will be directed to the home page of NOBUY RENT where the Services available will be displayed. You may update your Profile as and when necessary after Signing Up, by clicking on your profile picture portion or Profile settings.
3. Before or after setting up Your Profile, You shall also be required to provide details regarding Your location for personalising Your feed on NOBUY RENT. You shall be able to access all features of NOBUY RENT, only upon completion of all the necessitated process of setting up Your Profile.
4. You may change Your Location at any time, while using NOBUY RENT by clicking on the Location Option available on the Home Screen of NOBUY RENT.
5. NOBUY RENT showcases a wide variety of products and services based on Your Profile and Your Location. The Services may be showcased by NOBUY RENT based on
  1. Your location,
  2. Your preferences and
  3. preferences of other Users from the same location and/or with the same preferences as Yours etc.
6. NOBUY RENT provides its Services free of cost to the Users, however, NOBUY RENT reserves the absolute right to alter or modify the provision of Services based on a subscription fee payable by the Users monthly/annually, or in any other manner as provided by NOBUY RENT.
7. Other than the above-mentioned features, NOBUY RENT facilitates a panoramic and user-friendly experience by providing further options for the effective usage of its Services. NOBUY RENT provides for two categories, i.e., products and services offered for rent, based on Your location. Within the product/service option, there are various categories of the products/services offered; there are further sub categories of products/services offered under each such category.
8. You will be able to filter the products/services offered under each sub-category, on the basis of price, extent of usage, profile strength of the Vendor (determined based on profile information provided by the Vendor and other factors), etc. as permitted by NOBUY RENT.
9. Upon clicking on a product/service offered for rent or hire, the description and details regarding such product/service and contact details of the Vendor who has listed/offered the same for rent, shall be displayed. You may click upon the “View Contact” option to access the contact details of the Vendor, in order to coordinate with a Vendor and rent any product/service listed by such Vendor.
10. NOBUY RENT displays the products/services recently viewed by You, Your wishlist (based on products/services selected by You), notifications, the option to choose products or services to explore various categories of products/services, products/services that may have been featured/promoted on NOBUY RENT by the Vendors and also suggests products/services based on several factors. The products/services that have been featured/promoted shall appear
  1. on the home page,
  2. with the tag “featured” and/or
  3. with stars around the thumbnail displayed for such product/service.
11. The “search” option on the home page shall aid users in finding products/services that are listed by Vendors on NOBUY RENT.
12. NOBUY RENT enables its Users to edit their Profile information, track the Users’ activity in NOBUY RENT, seek information from NOBUY RENT through FAQs or the ‘Need Help’/’Contact’ option and such other collateral/ ancillary services that are provided for potential usage by NOBUY RENT.
13. The “+” option on the mobile application and “+ Add Listing” option on the webpage of NOBUY RENT shall enable a User to offer his/her products/services for rent on NOBUY RENT and upon listing a product/service, such a User shall become a Vendor on NOBUY RENT; and in such a case, the Terms and Conditions of Vendors shall apply.
14. The “Refer and Earn” option allows You to generate a referral code that may be copied and shared to third parties. When any third party creates an Account on NOBUY RENT based on such a referral code that You have generated and shared, You shall receive a number of Credits as a reward, as showcased therein. Users acknowledge and agree that this referral option does not provide any other gifts, discounts or coupons. The Credits may also be availed by completing specific tasks like providing complete details of Your profile etc., as permitted by NOBUY RENT. The Credits may be utilised in respect of the Services of NOBUY RENT on such conditions as may be stipulated therein.
15. You agree and acknowledge that, in the event that the Services are being utilized by You in contravention of these Conditions, NOBUY RENT shall have the right either at its sole discretion or upon the receipt of a request from the legal/statutory authorities or a court order to discontinue/terminate the said Service(s) to You as the case may be, and forthwith remove/block/close Your Account on NOBUY RENT and furnish such details about You upon a request received from the legal/ statutory authorities or under a court order.
16. You may delete Your Account on NOBUY RENT by addressing an email to support@nobuyrent.com. NOBUY RENT shall duly delete Your Account within reasonable time, upon receipt of such an email.
17. You agree and acknowledge that NOBUY RENT shall bear no responsibility vis a vis the delivery of any product taken for rent or provision of any service You have hired, including but not limited to shipping, time frame for delivery, mode and cost of shipping, and any damages connected therewith or incidental thereto.
4. Agreement to receive Mails & Phone calls
1. By way of accepting these Terms You hereby consent to the receipt of communication from us by way of e-mails, newsletters, WhatsApp messages & phone calls and agree to provide necessitated information and feedback required by NOBUY RENT.
5. Geographic Limitation:
1. You may access the services or other features on NOBUY RENT from only within the geographical territory of India and other geographical locations where NOBUY RENT offers the same on account of the applicable Laws imposed by concerned statutory authority. NOBUY RENT reserves the right to use technologies, programming or data to verify Your geographic location, at any point in time after Your Signing Up.
6. Links to other Sites
1. NOBUY RENT may contain links to other websites or software or mobile applications controlled by third parties. You acknowledge that NOBUY RENT is not responsible for and does not endorse the contents or use of these websites or software or mobile applications.
7. Public posts and Rating:
1. As a User of NOBUY RENT, You agree to use careful, prudent, and good judgment when leaving feedback or rating regarding NOBUY RENT. In the event that the feedback or rating is inappropriate or violates propriety or privacy of another User, or is in violation of any applicable Laws or NOBUY RENT Policies, the Company, in its sole discretion, may report the same to law enforcement authorities any actions that may be illegal.
2. You agree and acknowledge that NOBUY RENT at its sole discretion may remove any post, feedback or rating.
3. When legally required or at NOBUY RENT’s discretion, the Company may initiate investigation or raise complaints before appropriate forums of alleged illegal activity on NOBUY RENT.
4. Reporting inappropriate use of feedback or rating: You may contact the Grievance Redressal Officer (as provided under Section 14), regarding any inappropriate use of feedback or rating or other details.
5. NOBUY RENT does not and cannot review every posting made on the NOBUY RENT. These Terms do not require NOBUY RENT to monitor, police or remove any postings or other information submitted by You or any other User and NOBUY RENT shall not be responsible for any ensuing liability.
8. Intellectual Property Rights:
1. You hereby acknowledge that any and all intellectual property rights (including but not limited to all trademark, copyright, patent, service marks, domain name etc.) and other proprietary rights in and in relation to NOBUY RENT and the contents provided therein, including without limitation any compilation, data, materials, articles, drawings, depictions, explanations, call records, derivatives, improvements or modifications which ownership is directly attributable to NOBUY RENT (expressly excluding any personal information, intellectual property which belongs to a third party) and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by You or any other Vendor or User or third parties relating to NOBUY RENT or the Services shall vest wholly, completely, and fully with NOBUY RENT throughout the territory of the world and You shall not directly or indirectly infringe Intellectual Property Rights and have no right or claim to the Intellectual Property Rights in any manner whatsoever.
2. NOBUY RENT respects the intellectual property rights of others and expects You to do the same. You agree and acknowledge that You shall not infringe or pass off, directly indirectly, the intellectual property rights of others; and You agree to indemnify NOBUY RENT for any damage that may arise for NOBUY RENT, in the event of any action/claims brought by a Vendor, User or third party against NOBUY RENT in this relation.
3. At NOBUY RENT’s discretion and in appropriate circumstances, NOBUY RENT may remove any content submitted to NOBUY RENT and/or terminate the accounts of Users or prevent access to the NOBUY RENT by Users who infringe the intellectual property rights of others, unless such content/rights of such User is protected by an order of a Court.
4. If You believe that the intellectual property rights in Your work or in the work for which You act as an agent, or that of a third party has been infringed through NOBUY RENT, please contact NOBUY RENT’s representative agent for notice of claims of intellectual property rights infringement, Mr. Sathese Kumar, who can be reached through support@nobuyrent.com. However, You agree and acknowledge that any actions towards the said allegation may be taken by NOBUY RENT at its sole discretion, unless directed or bound by any order of the appropriate courts.
9. Disclaimer of Warranties and Liabilities:
1. You understand and agree that the Company provides NOBUY RENT on an 'as-is' 'with all faults' and 'as available' basis. You agree that the use of the NOBUY RENT is at Your risk. All warranties including without limitation, the implied warranties of merchantability and fitness for a particular purpose for title and non-infringement are disclaimed and excluded.
2. No representations, warranties or guarantees are made by us regarding the
  1. accuracy, adequacy, reliability, completeness, suitability or applicability of the information to a particular situation;
  2. uninterrupted, timely, secure, or error-free nature of the features;
  3. the quality of any products/services, content, information, or other material on the NOBUY RENT will meet Your expectations or requirements;
  4. any errors in the NOBUY RENT will be corrected;
  5. warranties against infringement of any third party intellectual property or proprietary rights; or
  6. other warranties relating to performance, non-performance, or other acts or omissions of the Company, its officers, directors, employees, affiliates, agents, licensors, or suppliers.
3. NOBUY RENT does not make any representation or warranty regarding the reliability, accuracy, completeness, correctness, or usefulness of User or Vendor or third party content, and disclaims all liabilities arising from or related to any User or Vendor or third party content. You agree and acknowledge that the details and information uploaded by the Users / Vendors regarding the products/services is verifiable directly with the Users /Vendors alone and NOBUY RENT shall not take any responsibility towards the accuracy and legitimacy of such information.
4. You acknowledge and undertake that You are accessing the services of NOBUY RENT and transacting at Your own risk and are using Your best and prudent judgment before entering into any transactions through NOBUY RENT. We shall neither be liable nor responsible for any actions or inactions of Vendors nor any breach of conditions, representations or warranties by the Vendors and hereby expressly disclaim any and responsibility and liability in that regard. We shall not mediate or resolve any dispute or disagreement between You and the Vendors.
5. You agree and acknowledge that NOBUY RENT is merely a marketplace e-commerce platform/facilitator and is not and cannot be a party to or control in any manner any transactions that happen pursuant to the Services. Accordingly, any contract that arises between You and the Vendor shall be a strictly bipartite contract between You and such Vendor. We further expressly disclaim any warranties or representations (express or implied) in respect of quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the products/services listed or displayed or transacted or the content (including product/service or pricing information and/or specifications) on the NOBUY RENT. While we have taken precautions to avoid inaccuracies in the content displayed on NOBUY RENT, all content, information (including the price of products/services), are provided as is, without warranty of any kind. We do not implicitly or explicitly support or endorse the hiring of any products/services on the website. At no time shall any right, title or interest in the products/services offered for rent or displayed on NOBUY RENT vest with NOBUY RENT nor shall NOBUY RENT have any obligations or liabilities in respect of any transactions on the website.
6. NOBUY RENT does not endorse any Vendor/listing. In the event that any Vendor has listed a product/service where such listing is misleading, duplicate in nature, insulting or detrimental towards the interest of any User or NOBUY RENT, or in violation of laws of India including but not limited to illegal or prohibited products/services, defective products/deficiency in services provided by the Vendor, infringement of intellectual property rights of Users/Vendors/NOBUY RENT/third parties by the Vendor, or for any other similar reasons, You may report such Vendor, or the product/service through the “Report” option available below every listing.
7. NOBUY RENT declares that it does not collect any financial information or payments from the Users through its website or application or through phone calls or messages or through any other methods, at any point in time.
8. You agree and acknowledge that no payments to be made to the Vendor shall be transacted through NOBUY RENT and any issue in relation with the rented product or hired service must be raised solely with the Vendor and any claims for refund/exchange/replacement in respect of the Services shall lie solely against the Vendor alone.
9. NOBUY RENT disclaims any liability towards collection, storage, usage of financial information or collection of payments from the Users, by Vendors or any third parties; Users acknowledge and agree that they shall not proceed against or initiate action against NOBUY RENT for any kind of damages whether personal, monetary or reputational etc., caused to You, by other Users, Vendors or any third parties or by Your own negligence in respect of usage of financial information or collection of payments etc., as stated in this clause, under any circumstances whatsoever.
10. The Company or anyone else involved in administering, distributing or providing the Services of NOBUY RENT further explicitly disclaims any and all liability for any mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, computer viruses or other harmful, disabling computer code, computer instructions, circuitry or other technological means whose purpose is to disrupt, damage or interfere with any computer and communications facilities or equipment ("Harmful Code") that may be transferred to Your Devices when accessing the NOBUY RENT. By way of clarification, Harmful Code shall include, without limitation, any code containing viruses, Trojan horses, spiderbots, worms or similar destructive code or code that was intentionally written to self-replicate. You are advised to obtain and use appropriate anti-virus and security software and to take all other appropriate measures to safeguard the integrity of Your Devices.
11. The Company does not warrant that any of the software used and/or licensed in connection with the NOBUY RENT will be compatible with other third party software or devices nor does it warrant that operation of NOBUY RENT and the associated software will not damage or disrupt other software or hardware.
12. Notwithstanding anything contained elsewhere in these Terms, in no event shall the Company or any of its directors, officers, employees, technicians, agents or content/service providers be liable to You or anyone claiming under You for any costs or loss incurred or suffered by You or anyone claiming under You, including but not limited to any special, exemplary, consequential, incidental, punitive or indirect damages on any theory of liability, whether in contract, tort (including without limitation negligence), strict liability, liability arising in relation to and out of the operations of NOBUY RENT, contents posted, transmitted, exchanged or received or violation of any Intellectual Property Rights or any of the Users’/Vendors’/third parties’ activities, negligence, inaction or omission or violation of Laws or otherwise. In no event or circumstance shall the Company be under any liability to make good any loss whether by way of any monetary payment or otherwise.
10. Indemnification:
1. Not withstanding anything provided under these Terms or NOBUY RENT Policies, by accepting these Terms and using the NOBUY RENT, You agree that You shall defend, indemnify and hold the Company, its directors, shareholders, officers, technicians, content/service providers and other representatives harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with:
  1. Your access to NOBUY RENT,
  2. Your use of the Services/features/facilities of NOBUY RENT, or
  3. Your violation or breach of these Terms or NOBUY RENT Policies or any applicable law or regulation;
  4. Your violation of any Intellectual Property Rights of any Vendor or User or third party; or
  5. Your misrepresentation, negligence or fraudulent activities in connection with the usage of NOBUY RENT
  6. any and all third-party claims based upon the content of any communications transmitted by You.
2. Not withstanding anything provided under these Terms or the NOBUY RENT Policies, You agree that You shall not commence, maintain, initiate, or prosecute, or cause, encourage, assist, volunteer, advise or cooperate with any other person to commence, maintain, initiate or prosecute, any action, lawsuit, proceeding, charge, petition, complaint or claim before any court, agency or tribunal against NOBUY RENT or any of the other matters discharged and released in this Agreement. You also agree that if You, or someone acting on Your behalf, should file, or cause to be filed, any such claim, charge, complaint, or action against NOBUY RENT, You expressly waive any and all rights to recover any damages or other relief from NOBUY RENT including, without limitation, costs and attorneys’ fees.
11. Termination:
These Terms will continue to apply until terminated by either You or Us as set forth below:
1. Termination by You: If You wish not to be bound by these Terms, You may terminate Your relationship with Us by deleting Your Account and stop accessing and using NOBUY RENT. Please note that deleting Your Account does not delete any or all posts, contents, feedback, ratings and report provided from or through Your Account as the said information belongs to NOBUY RENT. You will have to delete them personally if You decide to do so. NOBUY RENT owns the right to store, retain, modify, alter, use, transmit, publish, disseminate, distribute, remove or delete the said contents in a manner and purpose, as decided by NOBUY RENT, in accordance with the Privacy Policy.
2. Termination by Us: NOBUY RENT may at its discretion and at any time with or without notice, terminate Your Account or suspend the Terms, restrain or limit the usage of certain features or Services, with or without cause if:
  1. NOBUY RENT is unable to verify or authenticate any information provided by You or
  2. You breach any of the provisions of these Terms,the Privacy Policy or any other laws, anywhere in the world, that may be applicable to You; or
  3. Company is required to do so in accordance with or in pursuance of Your violation of, applicable Laws; or
  4. NOBUY RENT has reasonable grounds for suspecting any unlawful, illegal, fraudulent or abusive activity on part of You or on account of any of Your activity suspected to be against the interests of any User or Vendor or NOBUY RENT
  5. Company has elected to discontinue, with or without reason, access to NOBUY RENT (or any part thereof) either in general or specifically to You.
3. NOBUY RENT shall not be liable to You or any third party for any such termination.
12. General:
1. To the extent that anything in or associated with NOBUY RENT is in conflict or inconsistent with these Terms, these Terms shall take precedence and prevail. Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision. Our rights under these Terms shall survive any discontinuance of the access or use of NOBUY RENT.
2. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
3. Any notices to You from Us regarding NOBUY RENT or these Terms will be posted on NOBUY RENT and may be sent to You through e-mail/phone number/other applications.
4. Governing Law: In case of any disputes or differences between the Users and NOBUY RENT:
  1. These Terms shall be governed and construed under the laws of India, without any reference to its conflict of law and rules, and the courts of Coimbatore, Tamil Nadu, India shall have exclusive jurisdiction,
  2. The same shall be resolved by Conciliation under Arbitration and Conciliation Act, 1996. If the said disputes or differences are not settled by Conciliation, the Parties shall resolve them by Arbitration before the sole arbitrator under Arbitration and Conciliation Act, 1996, incorporated at the above address. The language of the arbitration proceedings shall be English and the seat shall be at Coimbatore, Tamil Nadu, India.
13. Severability:
1. All the portions of these Terms, are intended to be and shall be, independent and severable, and in the event that any term or portion thereof is determined to be unlawful, invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision, or portion thereof, of these Terms, and all other provisions and portions thereof shall continue to be valid and enforceable.

We encourage You to contact Us, the NOBUY RENT Nodal Officer vide the below indicated contact details (as provided in accordance with Information Technology Act, 2000, Personal Data Protection Act, 2023 and any Rules made thereunder), if You have any questions concerning Our Terms or the NOBUY RENT Policies, usage/access of NOBUY RENT or any other queries or grievances or clarifications in relation to the same.

TERMS AND CONDITIONS FOR 'VENDORS' OF NOBUY RENT

Your access and use of the NOBUY RENT, its services and tools are governed by the following terms and conditions Conditions including any applicable policies, rules, code, conditions and guidelines of NOBUY RENT “NOBUY RENT Policies” which are incorporated herein by way of reference and/or which may be issued by NOBUY RENT from time to time, with or without prior notification. By mere use of the NOBUY RENT, You are agreeing to comply with and be bound by the following Conditions.

For the purpose of these Conditions, wherever the context so requires "You" or "Vendor(s)" shall mean any natural or legal person who uses NOBUY RENT as a “Vendor” as defined below. The term “User(s)” shall mean any natural or legal person who does not fall under the above category but visits, accesses, browses or uses NOBUY RENT to avail the Services offered by NOBUY RENT and indicate “Receiver(s)” as specified in the Website and Mobile Application.. The term “We”, “Us”, & “Our” and “Company” shall mean NOBUY RENT and/or its assignees, employees and authorised representatives.

These Terms are published in compliance with and are governed by the provisions of Indian law (as amended from time to time), including:

the Indian Contract Act, 1872;
the (Indian) Information Technology Act, 2000 and the rules, regulations, guidelines and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011; and
The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021,
Personal Data Protection Act, 2023,

And rules and guidelines framed thereunder, and other applicable laws. It is mandatory for You to Sign Up and register Yourself with NOBUY RENT as detailed hereunder to gain access to Our contents. When You use NOBUY RENT, You will be subject to the NOBUY RENT Policies applicable to any service, and they shall be deemed to be incorporated into the Conditions and shall be considered as part and parcel of the Conditions. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Conditions, at any time without any prior written notice to You. The changes or any modifications will be intimated to You within thirty (30) days of its updation and it is Your responsibility to review these Conditions periodically for updates / changes. Your continued use of the NOBUY RENT following the posting of changes will mean that You accept and agree to the revisions.

ACCESSING, BROWSING, DOWNLOADING OR OTHERWISE USING NOBUY RENT INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE CONDITIONS, SO PLEASE READ THE CONDITIONS CAREFULLY BEFORE PROCEEDING.

1. Definitions:
1. Confidential information means and includes any and all information which is confidential to NOBUY RENT and the Vendor including any
  1. business information and business processes,
  2. any samples, formulations, specifications, data relating to manufacturing and quality control processes and procedures,
  3. advertising and marketing plans,
  4. any past, current or proposed development projects or plans for future development work,
  5. technical, marketing, financial and commercial information whether relating to past or current or future,
  6. the commercial and business affairs of NOBUY RENT or the Vendor,
  7. all User (customer) related information including their personal information as defined under the Privacy Policy, details of the orders placed, rates and discounts etc., and
  8. information with respect to NOBUY RENT, which shall include the User database and any other information connected therewith or incidental thereto.
2. Credit(s) shall mean the reward token provided by NOBUY RENT to the Vendor on NOBUY RENT in recognition of the Vendor's efforts to complete their profile information and establish social media account linkages and/or reward tokens purchased on NOBUY RENT.
3. Device(s) means any device, usually electronic, that processes data according to a set of instructions, which may include but not limited to workstations, personal computers, laptops, netbooks, personal digital assistants, tablets, and smartphones;
4. Vendor shall mean and include professionals or business vendors or service providers or any individual, who list their products or services for rent or hiring respectively, or properties for rent, on NOBUY RENT. The term “Vendor” refers to “Owner(s)” as indicated in the Website and Mobile Application.
2. Representation and Warranties:
By accessing or using NOBUY RENT, You represent and warrant that:
1. You are an individual/entity falling within the meaning of “Vendor” as defined under these Conditions and possess all valid licenses, certifications and experience under applicable laws to offer Your products/services;
2. While listing Your products/services for rent on NOBUY RENT, You have duly complied with all relevant laws, rules and regulations applicable to You in connection with such products/services
3. You are either at least 18 years old or You are using NOBUY RENT under parental/legal guardian’s guidance and consent, at all times;
4. You have the lawful authority and capacity to contract and be bound by these Conditions;
5. You represent and warrant to us that:
  1. if You are a business, You are duly organized, validly existing and in good standing under the existing laws, rules and regulations applicable to You;
  2. You have all requisite rights, power, and authority to enter into these Conditions, perform Your obligations, and grant the rights, licenses, and authorizations in this Conditions;
  3. any information provided or made available by You or Your affiliates to NOBUY RENT or its affiliates are at all times accurate and complete;
  4. You and all of Your employees, subcontractors, agents, suppliers and any associates of Yours, will comply with all applicable Laws in the performance of Your obligations and adherence to NOBUY RENT Policies
  5. You have secured any and all clearances, permissions, approvals, authorizations, rights and licenses necessary for listing any product/service on NOBUY RENT, and to display the information relating to such products/services, data, images, and/or use the intellectual property in connection with the products/services or information uploaded by You on NOBUY RENT.
  6. There are no proceedings pending against You, which may have a material adverse effect on Your ability to perform and meet the obligations under these Conditions.
  7. Any configuration or set up of the Devices for gaining access to the NOBUY RENT shall be Your sole responsibility.
  8. You are solely responsible to keep Your login credentials and accessibility to the Your Account, including but not limited to Your e-mail id, Your passwords, access to Your Devices etc., secure;
  9. You shall immediately notify NOBUY RENT of any actual or suspected or unauthorised use or access of Your Account by any other User, Vendor or any third parties.
6. Although NOBUY RENT shall not be liable for any of the consequential losses caused by any unauthorised use of Your Account, You may be held liable for the damage or loss caused to NOBUY RENT or to its Users or Vendors or any third parties as the case may be, due to any unauthorised use of Your Account.
7. If You are accepting these Conditions on behalf of a company, limited liability partnership or any other legal entity (“Entity”) or Your employer, principal, contractor (“Principal”) You have the authority to bind such Entity and Principal to these Conditions and, in such an event, “You” and “Your” as used in these Conditions shall refer to such Entity and Principal;
8. You agree to adhere to the laws, rules, regulations, circulars, notifications, guidelines, by-laws and policies issued by authorities that are/may be applicable to You including but not limited to the laws of India, for the time being in force (“Laws”), at all times;
9. You agree that NOBUY RENT is a local discovery platform providing products/properties for rent and services for hire that are available in and around Your location (“Services”) and providing a marketplace where Vendors providing such products and services for rent/hire, properties for rent meet. (Any reference to “product or services” in the context of products/services listed on NOBUY RENT, shall also include properties or any other matters listed on NOBUY RENT).
10. NOBUY RENT reserves the right to terminate Your membership and/or refuse to provide You with access to NOBUY RENT, if it is brought to NOBUY RENT’s notice or if it is discovered that You are not eligible to use NOBUY RENT or You are in breach of NOBUY RENT Policies.
3. Access and Use:
NOBUY RENT grants You a limited, personal, non-exclusive, non-transferrable and non-licensable right and access to use NOBUY RENT, subject to the Conditions and the following representations and warranties:
1. You shall only access NOBUY RENT using authorized and lawful means;
2. NOBUY RENT shall not be liable for any failure or default to provide access to the NOBUY RENT on account of any failure or delay by You to setup Your profile and create Your Account, for such access;
3. Any configuration or set-up of the Devices for access to the NOBUY RENT shall be Your sole responsibility.
4. We collect, store, process and use Your information in accordance with Company’s Privacy Policy. By using NOBUY RENT and/ or by providing Your Personal Information (as defined in the Privacy Policy), You consent to the collection and use of the information You disclose to Us, in accordance with the Privacy Policy;
5. The Services of NOBUY RENT may be accessed and utilised by signing up using Your mobile number and by providing all the other details necessitated by NOBUY RENT. (“Sign Up”). A One Time Password (OTP) will be sent to Your registered mobile number via SMS, which will be required to be entered to Sign Up on NOBUY RENT. After Signing Up with NOBUY RENT and registering the necessitated details, You can log in and access Your profile/account (“Account”) using the login credentials.
6. You may login to Your account to access the contents of NOBUY RENT, through the following means:
  1. OTP verification through SMS or
  2. Gmail or through other applications/platforms, or in any other mode as permitted by NOBUY RENT.
7. You are solely responsible to keep Your login credentials and accessibility to Your Account, including but not limited to Your e-mail id, Your passwords, access to Your Devices etc., secure; You shall immediately notify NOBUY RENT of any actual or suspected or unauthorised use or access of Your Account by any other User or Vendor or any third parties. Although NOBUY RENT shall not be liable for any of the consequential losses caused by any unauthorised use of Your Account, You may be held liable for the damage or loss caused to NOBUY RENT or to its Users or Vendors or any third parties as the case may be, due to any unauthorised use of Your Account.
8. You shall upload Your true and accurate profile information in Your Account, to enable interaction with You on NOBUY RENT and for NOBUY RENT to provide effective services to its Users and Vendors. However, in respect of modification or change or update of information that You wish to make in Your Account, NOBUY RENT reserves its rights to verify, refuse or allow such modification or change or updation upon verification or authentication.
9. NOBUY RENT shall not be liable for any fake, inactive, innaccurate, fraudulent, misleading, impersonating, non-existing Accounts created by Users or Vendors.
10. You shall not knowingly include or use any false, inaccurate, incomplete, disintegrated or prohibited information while using NOBUY RENT; You shall not take any action that interferes with, degrades or adversely affects the Services provided by and reputation of, NOBUY RENT;
11. You shall not use NOBUY RENT in a manner (i) that is prohibited by any law or regulation, or facilitates the violation of any law or regulation; or (ii) that shall disrupt any other Vendor’s or User’s usage of NOBUY RENT (iii) that violates or tampers or reasonably appears to violate or tamper with the programmed functioning and security of NOBUY RENT;
12. You shall not use NOBUY RENT, for other purposes including but not limited to transmit, publish, post, upload, distribute or disseminate any inappropriate, harassing, abusive, defamatory, libellous, obscene, sexual, illegal, ethnically objectionable or deceptive content as opposed to the applicable Laws;
13. You shall not copy, modify, adapt, translate, store, transmit, publish, distribute, disseminate, or reverse engineer the information or the content available in NOBUY RENT, without specific written authorization from NOBUY RENT, that otherwise violates and infringes the rights of NOBUY RENT in any manner whatsoever, in accordance with the applicable laws;
14. You shall ensure that NOBUY RENT is not used to upload, post, transmit, or otherwise make available any content that contains a virus or any other form of malicious code or data, any engine, software, tool, agent or any device or mechanism (such as spiders, robots, avatars or intelligent agents) that is likely or intended to have an adverse impact on NOBUY RENT or any other software, hardware, services or data in and of NOBUY RENT or provide unauthorized access of NOBUY RENT, to Yourself or any other Vendors or Users or any third parties;
15. You shall not attempt to gain unauthorised access to any accounts, computer systems or networks connected to NOBUY RENT, through hacking, or any other means, or obtain or attempt to obtain any materials or information through any means not intentionally made available to You.
16. You shall not copy, modify, adapt, translate, or reverse engineer any portion of the NOBUY RENT, its contents or materials and/or the services. You shall not access or use NOBUY RENT to develop, or to assist anyone in developing competitive and/or similar services provided by NOBUY RENT;
17. In the event of technology-related problems due to various reasons including but not limited to internet interruption or communication Device malfunction, the Vendor shall take all due efforts to resolve such problems in order to facilitate the operation of NOBUY RENT.
18. You are prohibited from endorsing, publishing, soliciting, promoting, sharing, distributing, transmitting any posts, hyperlinks, invitations, offers, in any form, whether directly or indirectly, to the Users or other Vendors for any other purpose, inside or outside NOBUY RENT, including but not limited to
  1. Any unsolicited communications, messages, information for the purpose of collecting or disseminating information from/amongst the Users or Vendors etc.,
  2. Information that belongs to another person and to which You not have any right;
  3. Information relating to providing job opportunities; or
  4. hosting/promoting/sharing information about or hyperlinks to any third party applications, softwares or events in NOBUY RENT; or
  5. hosting/promoting/sharing information about any product or service provided by any third parties or Users or Vendors
  6. sharing of information that is sexual, racist, discriminatory, or relate to prostitution, child/women trafficking, drug abuse and anything prohibited by law; or
  7. sharing of information that are prohibited and are punishable under Indian Penal Code, 1860 or any other law for the time being in force; or
  8. Promotion of political party(ies), their agendas, their idealogies; or
  9. Promotion of any religion(s), religious sentiments, practices and activities
  10. Sharing Harmful Code (as defined under these Terms) to access, collect, copy, deciper, use, alter, transform, duplicate, modify, process, decompile, disassemble, frame, hot link, deep link or reverse engineer any information of the User or Vendor or NOBUY RENT, irrespective of the nature of the information and the purpose, affecting the rights or interests or security or privacy or reputation of the Users or of the Vendors or of NOBUY RENT, whether directly or indirectly;
  11. Sharing information that is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
  12. Information that is harmful to children;
  13. Information that impersonates another person;
  14. Information that is in the nature of an online game that is not verified as a permissible online game;
  15. Information that is in the nature of advertisement or surrogate advertisement or promotion of an online game that is not a permissible online game, or of any online gaming intermediary offering such an online game;
  16. sharing of information that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation;
  17. And sharing any other information, documents, materials, contents that are unlawful, illegal, harmful, misleading, misrepresentative, infringing the rights including intellectual property rights and against the interests of other Users or Vendors or NOBUY RENT.
  18. Information that violates any law for the time being in force;
  19. And anything contrary to Section 3(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
19. You agree and acknowledge that NOBUY RENT does not provide a platform for You to sell Your products/services directly or indirectly; and it only provides a platform to market for renting such products/services. You further agree and acknowledge that NOBUY RENT does not provide a platform for making any payment on its website or mobile application, for renting or hiring any product/service and any such transaction can happen only between You and the User out of NOBUY RENT platforms. Thus, You agree and acknowledge that any transaction/proposed transaction between You and the Vendor is strictly bipartite contract.
20. You acknowledge that NOBUY RENT shall not be liable at any time, for any comments or feedback or ratings given by any of the Users in relation to the products/services or provided by the Vendors.
21. You acknowledge that NOBUY RENT has discretionary rights to publish or modify or moderate or mask (where required by law or norm etc.) the feedback or comments or ratings provided by the Users, as necessitated under circumstances, whenever NOBUY RENT deems that such modification or moderation is necessary.
22. You agree not to engage in any competing activity at all times, in relation to the services provided by NOBUY RENT as an aggregating platform providing access to Vendors, and any other activity that competes with the business, any proposed businesses, or business interests of the Company or its affiliates or associates, without the Company’s prior written consent.
23. NOBUY RENT hereby reserves the right to mandate the production of any relevant document relating to Your business or product/service offered by You on NOBUY RENT and such other documents as may be required to validate Your eligibility to offer Your products/services on NOBUY RENT. You hereby consent to undergo a manual KYC verification process at any time, after creating Your account on NOBUY RENT.
24. NOBUY RENT shall not be liable for any kind of damages, owing to Your negligence or ignorance of any appropriate terms and conditions as well as ignorance or non-observance of NOBUY RENT Policies and no refund or compensation shall be availed by You, in case of any consequences of inaction or omission in observing NOBUY RENT Policies or any other terms and conditions or violation of NOBUY RENT Policies.
25. You shall be solely responsible for all problems, conditions, delays, delivery failures and all other loss or damage arising from or relating to the products/services offered by You on NOBUY RENT and to the Users of NOBUY RENT.
26. You agree and acknowledge that You shall take reasonable endeavours and maximum efforts to maintain the quality and timely provision of products/services to the Users and conduct business in good faith, without negligence, malpractice, unfair trade practice, defect, deficiency etc.
27. From time to time, NOBUY RENT may introduce, insert, modify, alter, delete, post, update any data, information, Services, contents, algorithm, features, facilities and/or any other information in NOBUY RENT, whether for the purpose of fixing an error, bug or other issue in the NOBUY RENT or enhancing the functionality of NOBUY RENT (“Upgrades”) and that such Upgrades may result in changes in the contents, appearance and/or functionality of NOBUY RENT. You may be required to install some of the Upgrades to NOBUY RENT in Your Device(s) in order to continue to access or use NOBUY RENT, or portions thereof.
28. You agree and acknowledge that NOBUY RENT does not and cannot review every posting made on NOBUY RENT. These Conditions do not require NOBUY RENT to monitor, police or remove any postings or other information submitted by any Vendor or User and NOBUY RENT shall not be responsible for any ensuing liability. However, You acknowledge that NOBUY RENT may exercise its editorial/censorship rights over any posts, content or information shared by You, if the same are not consistent with these Conditions and Privacy Policy, and/or any other NOBUY RENT Policies.
29. You shall be solely liable in relation to
  1. Lack of professional ability or qualification in fulfilling the provision of products/services offered by You;
  2. Your provision of wrong/irrelevant/inappropriate products/services to the Users;
  3. Quality of products/services provided by You to the Users;
  4. Your action or inaction, omission, delay, negligence or misrepresentation while providing any product/service the to the Users; and
  5. any issues or concerns or problems arising in or outside NOBUY RENT relating to any of the products rented or services hired by the Users from You; NOBUY RENT shall not be held liable for any of the above-listed circumstances and Vendors hereby undertake to indemnify NOBUY RENT through monetary and other means, against any consequential loss or damage, whether direct or indirect, resulting from the above issues, problems or concerns
30. You shall duly report any instance of criminal cases, warrants or insolvency proceedings initiated or pending against You. The initiation or pendency of such cases may result in the immediate removal of Your Account from NOBUY RENT, wherein NOBUY RENT shall not be liable to indemnify any losses suffered by You as a result of such removal.
31. NOBUY RENT shall not be responsible in any manner for the authenticity of the personal information or sensitive personal data or information supplied by the User to Vendors or NOBUY RENT or to any other person acting on behalf of NOBUY RENT. NOBUY RENT does not make any representation or warranty regarding the reliability, accuracy, completeness, correctness, or usefulness of User or Vendor or third party content, and disclaims all liabilities arising from or related to any User or Vendor or third party content. You agree and acknowledge that the details and information uploaded by the Users / Vendors regarding the products/services is verifiable directly with the Users /Vendors alone and NOBUY RENT shall not take any responsibility towards the accuracy and legitimacy of such information.
32. You hereby agree to cooperate with NOBUY RENT, at all times, for the purpose of providing/sharing any information, feedback, data, materials etc., for the purpose of providing ethical, effective and uninterrupted Services on NOBUY RENT.
33. You hereby consent and authorise NOBUY RENT to record, study, process, compile, disclose and share any necessary and relevant data to third parties or on social media, pertaining to the Vendors’ preferences, and/or feedback/listings, for the purpose of facilitating ethical, effective and uninterrupted Services in NOBUY RENT.
34. We may at any time cease providing any or all of the Services at Our sole discretion and without notice.
35. You agree that NOBUY RENT may contact You through telephone, email, SMS, or any other electronic means of communication for the purpose of:
  1. Obtaining feedback in relation to the website or NOBUY RENT’s services; and/or
  2. Obtaining feedback in relation to any Users/Vendors who use or yet to use NOBUY RENT; and/or
  3. Resolving any complaints, information, or queries by Vendors or other Users etc.
  4. And for any other purpose in order to provide efficient and effective services to the Users and Vendors
  And You agree to provide Your fullest co-operation to further such communication by NOBUY RENT, subject to these Conditions.
36. You acknowledge that the Conditions, Privacy Policy and any such policies, rules, guidelines issued by NOBUY RENT, with or without notice, in addition to all the amendments or modification of these Conditions, or Upgrades shall bind You under all circumstances, without any further notice.
37. By accepting these Conditions, You unequivocally agree not to act against the interests and reputation of NOBUY RENT, in any manner whatsoever.
38. NOBUY RENT is committed towards creating a safe and secure environment for Users and Vendors, free from harassment of any kind (sexual or otherwise), unlawful discrimination, intimidation, etc., and you agree and acknowledge that no such unlawful activity shall be undertaken by You while availing the Services. Any such unlawful activity may be reported by You by reaching out to support@nobuyrent.com. However, you acknowledge and agree that NOBUY RENT is not the designated or appropriate authority to pursue any legal action in such matters. You also acknowledge and agree that any claims/actions against other Users or Vendors regarding the same may be pursued and remedied before appropriate legal authorities. NOBUY RENT specifically disclaims all or any liability relating to the same.
39. You acknowledge and agree that any issue/claim against a User in the event of, any damage or unlawful retention of the products provided to any User on rent, or untoward treatment meted out to You in connection with Your service or dispute in payments and price for products/services or any other issues between the User and the Vendor shall be raised and resolved outside the scope of NOBUY RENT; We shall take due course of action against any such User, if you write to as at support@nobuyrent.com. You acknowledge and agree that NOBUY RENT is not the designated authority to address such issues, and that You are free to pursue action/claims against damages caused by any User, before any other appropriate legal authority.
4. Mode of Operation:
1. The Services of NOBUY RENT can be accessed by You, by registering on NOBUY RENT through Your phone number or e-mail, thereby creating Your Account. After creating Your Account, You will be directed to the home page of the application where a list of the products or services available will be displayed.
2. Upon creating Your Account, You may facilitate better Services for Your Account by setting up Your profile by providing necessary details, including but not limited to Your Name, Gender, Age, Date of Birth, Address, Address proof, ID Proof, WhatsApp Number, Mobile Number, E-mail, Occupation, Education, Interests, as required/mandated by NOBUY RENT (“Profile”). After setting up Your Profile, You will be directed to the home page of NOBUY RENT where the Services available will be displayed.
3. Before or after setting up Your Profile, You shall also be required to provide details regarding Your location for personalising Your feed on NOBUY RENT. You shall be able to access all features of NOBUY RENT, only upon completion of all the necessitated process of setting up Your Profile.
4. You may change Your Location at any time, while using NOBUY RENT by clicking on the Location Option available on the Home Screen of NOBUY RENT.
5. The products and services listed by You shall be visible to Users in Your location, based on the proximity ranges fixed by NOBUY RENT, at its own discretion.
6. You shall upload Your true and accurate profile information in Your Account, to enable Users to find and interact with You at NOBUY RENT and for NOBUY RENT to provide effective Services to You and its Users and Vendors. However, in respect of modification or changes or updates in the information that You wish to make in Your Profile/Account, NOBUY RENT has the right to verify, refuse or allow such modification or change or updation upon verification or authentication.
7. Upon creating Your Account and setting up Your Profile, You shall be able directed to the home page of NOBUY RENT, where the “+” option on the mobile application and “+ Add Listing” option on the webpage of NOBUY RENT shall enable You to offer Your products/services for rent on NOBUY RENT.
8. Upon clicking on the add listing option, You shall be required to choose whether You are listing a product or a service. After choosing the same, You shall be required to choose the category that product/service falls under, along with the nature/specifics of the product/service under the given categories. You shall also be required to provide a title, description and notes for handling, and other details regarding the product/service, and Your address and location vis a vis the product/service that You are listing.
9. Subsequent to provision of details regarding a service that You are listing, You shall be required to enter details regarding Your experience in offering such service and keywords regarding the service. You shall also be required to enter the fee charged by You (and the basis, i.e., daily, monthly, yearly, hourly or weekly, etc.) in respect of the service, choose whether such fee is fixed or negotiable and upload an image to be displayed for Your listing.
10. After entering the above, Your listing consisting of the details entered by You, shall be displayed on NOBUY RENT, visible to all Users, under the appropriate category and sub category. Your listing shall appear on the search results of a User, based on date on which it was uploaded, and the product/service sought for by You. Further, Your listing may appear in the search results, based on the following order of priority:
  1. promoted listings shall appear over listings that have not been promoted; however, listings promoted through hallmark advertisement shall not appear over listings that have not been promoted;
  2. listings that have been promoted more recently shall appear over listings that have been promoted prior to such recently promoted listings;
  3. the listings that have not been promoted shall be listed in the order of time of listing; i.e., recently uploaded listings shall appear over previously uploaded listings.
11. You may promote Your listing(s) on NOBUY RENT. By clicking on the “My Listings” option on NOBUY RENT, You shall be able to view and access all Your listings, where there shall be an option labelled “Promote.” Upon clicking on the “Promote” option, You shall be directed to the different kinds of promotions’ options offered by NOBUY RENT to its Vendors, as provided and described on NOBUY RENT, which are:
  1. Homepage advertisement
  2. Comprehensive Advertisement
  3. Featured Advertisement
  4. Hallmark Advertisement
12. The Homepage advertisement shall make Your Listing appear on the homepage of NOBUY RENT. The Comprehensive Advertisement shall promote Your Profile as a whole, and clicking upon the same shall redirect to Your Profile and all Your listings on NOBUY RENT. The Featured Advertisement shall make Your listing appear with the tag “Featured.” The Hallmark Advertisement shall make Your listing appear highlighted with stars/colours etc
13. The features of the different kinds of promotions mentioned above, including the period of display and price of each, target, placement, uniqueness, responses and graphical assistance, shall be displayed upon clicking on the “Promote” option; after assessing the same, You may click on the “Choose Plan” option beneath each kind of promotion in order to choose one.
14. The promotions shall be purchased by Vendors only through Credits. In the event that the Vendor does not possess sufficient Credits to purchase a promotion, the Vendor may “Buy Credits” through payment of the appropriate prices displayed for the same.
15. Upon clicking on the “Choose Plan” option as mentioned above, the Vendor shall be required to provide a thumbnail of the advertisement that he wishes to display on NOBUY RENT; and such thumbnail shall adhere to the dimensions specified therein. The Vendor shall also be required to choose the date from which the promotion may be activated; based on which the promotion shall be displayed by NOBUY RENT for the appropriate period as per the kind of promotion chosen by the Vendor.
16. Upon clicking on the “Buy Credits” option, You shall be able to purchase Credits under three categories, namely, Elite, Diamond and Platinum, for a fixed number of credits under each category, at a predetermined price, as displayed on NOBUY RENT. You may choose any one of the three categories of the Credits and click on the “Buy Now” option displayed thereunder, in order to proceed to the payment options. You may make Your payment through Unified Payments Interface (UPI), Debit/Credit Card, Netbanking or e-wallets.
17. The “Refer and Earn” option allows You to generate a referral code that may be copied and shared to third parties. When any third party that creates an Account on NOBUY RENT based on such a referral code that You have generated and shared, You shall receive number Credits as a reward.
18. You may also add new listings by clicking on the “Add new listing” option; view the products/services already listed by You by clicking on the “My listing” option; view the listings that You have promoted on the “Promoted Listing” option; buy Credits by clicking on the “Buy Credits” option, check the status of Your Credits, such as Credits previously purchased and redeemed, Credits awarded, and available Credits on the “Credit Status” option.
19. NOBUY RENT shall merely act as a facilitator between You and the User and shall bear no responsibility in relation with any communication/transaction between You and other Users.
20. NOBUY RENT may facilitate interaction between the User and Vendor, through emails, messages, calls or any other mode; NOBUY RENT does not store or intercept such calls or communications. The phone call option facilitated by NOBUY RENT shall be based on a phone carrier that is synced with Your Device. You agree and acknowledge that You shall not involve in any prohibited or unlawful activity during such calls and communications. Any claims/actions against other Vendors or Users regarding any unlawful or prohibited activities may be pursued before appropriate legal authorities; NOBUY RENT shall not be liable for any damages suffered by You as a result of such unlawful or prohibited activities by other Users or Vendors.
21. You shall ensure that the information relating to the products/services displayed on NOBUY RENT are of true and correct specifications and there are no misrepresentations whatsoever. Any necessary guarantee/warranty shall be provided by You to the user.
22. You hereby covenant with NOBUY RENT as under:
  1. To endeavour to duly provide the product/service displayed on NOBUY RENT to the Users, in accordance with any terms, conditions, representations and warranties that may have been undertaken between You and the User in respect of the specific products/services
  2. To provide products/services within the time committed and without any delay to the users
  3. Not to send any kind of promotion material or any such material, which is, derogatory to and/or adverse to the interests, financial or otherwise of NOBUY RENT, to the User either along with the products/services provided or in any manner whatsoever.
  4. Not to do any act/deal in any products/services which are either banned/prohibited by law or products/services that are dangerous to life or property or violate any of the intellectual property rights of any party in respect of such products/services.
  5. To provide to NOBUY RENT, for the purpose of the creation/display on NOBUY RENT, the description, images, disclaimer, delivery timelines, price and such other details for the products/services to be displayed and offered for rent.
  6. To provide the full, correct, accurate and true description of the product/service so as to enable the customers to make an informed decision.
  7. Not to offer any product/service on NOBUY RENT, which are prohibited for sale, dangerous, against the public policy, banned, unlawful, illegal or prohibited under Indian laws.
  8. To provide satisfactory proof about the ownership/licences of all the legal rights in relation to the products/services listed by You on NOBUY RENT, as and when demanded by NOBUY RENT.
23. You declare that You have all rights and authorisations in respect of intellectual property rights of third parties and are authorised to provide such products/services to the User. The copy of such authorization shall be provided to NOBUY RENT on demand without failure and/or protest.
24. You agree and acknowledge that You shall not use NOBUY RENT in a manner
  1. that is prohibited by any law or regulation, or facilitates the violation of any law or regulation; or
  2. that shall disrupt the usage of NOBUY RENT by any other Vendors or Users
  3. that violates or tampers or reasonably appears to violate or tamper with the programmed functioning and security of NOBUY RENT.
25. You agree and acknowledge that NOBUY RENT may exercise its editorial/censorship rights over any posts, content or information shared by You, if the same are not consistent with these Conditions and/or Privacy Policy and/or any other NOBUY RENT Policies.
26. NOBUY RENT may contact You through telephone, email, SMS, or any other electronic means of communication for the purpose of:
  1. Obtaining feedback in relation to website or NOBUY RENT’s Services; and/or
  2. Resolving any complaints, information, or queries by other Vendors or Users etc.
  3. Providing notices regarding changes to these Conditions;
  4. And for any other purpose in order to provide efficient and effective Services to the Users and Vendors
  And You agree to provide Your fullest co-operation to further such communication by NOBUY RENT, subject to these Conditions.
27. You acknowledge that NOBUY RENT has discretionary rights to publish or modify or moderate or mask (where required by law or norm etc.) the products or services listed by You, as necessitated under circumstances.
28. You acknowledge that these Conditions, Privacy Policy and NOBUY RENT Policies, with or without notice, in addition to or in modification of these Conditions shall bind You under all circumstances.
29. You agree and acknowledge that NOBUY RENT, at all times during the continuance of these Conditions, shall have the right to remove/block/delete any text, graphic, image(s) uploaded by You on NOBUY RENT, without any prior intimation to You, in the event that the said text, image, graphic is found to be in violation of law or breach of these Conditions. In such an event, NOBUY RENT reserves the right to forthwith terminate this Conditions with the You with intimation and without any liability.
30. You agree and acknowledge that, in the event that the Services are being utilized by You in contravention of these Conditions, NOBUY RENT shall have the right either at its sole discretion or upon the receipt of a request from the legal/statutory authorities or a court order to discontinue/terminate the said Service(s) to You as the case may be, and forthwith remove/block/close Your Account on NOBUY RENT and furnish such details about You upon a request received from the legal/ statutory authorities or under a court order.
31. You agree and acknowledge that, NOBUY RENT shall provide no return/refunds whatsoever under any ground in respect of the Credits purchased by You; and the Credits purchased by You may not be encashed at all times. However, such Credits shall remain in Your Account, and may be utilised at any time. Any issue in relation to the monetary transaction with NOBUY RENT may be brought to the notice of NOBUY RENT by addressing an email to support@nobuyrent.com and such issue may be looked into.
32. You agree and acknowledge that promoting Your listing does not provide any guarantee as to renting of Your products or hiring of Your service; and promotions merely aid in increasing the visibility of Your product/service.
33. You may delete Your Account on NOBUY RENT by addressing an email to support@nobuyrent.com. NOBUY RENT shall duly delete Your Account within reasonable time, upon receipt of such an email.
34. You agree and acknowledge that You shall, vis a vis the products offered on NOBUY RENT, duly ensure that:
  1. such products are of appropriate quality, standard and in adherence with laws governing such products, including but not limited to BIS Certification Norms and regulations and valid permits;
  2. the laws relating to vehicles, including but not limited to Motor Vehicles Act, 1988, Central Motor Vehicles Rules, 1989, Environment (Protection) Act, and Rules, 1986, Carriage by Road Act, 2007, Commercial Vehicle Act of 1988, and allied regulations therein are duly adhered to;
  3. in respect of electronic products, the related laws including but not limited to BIS Certification Norms, Electronics and Information Technology Goods (Requirement of Compulsory Registration) Order, 2021 and allied regulations therein are duly adhered to;
  4. in respect of agricultural products, the related laws including but not limited to The Insecticides Act, 1968 and Insecticides Rules, 1971, Fertilizer (Control) Order, 1985, Environment (Protection) Act, and Rules, 1986, and pollution control laws, and allied regulations therein are duly adhered to;
  5. in respect of animals/pets, the related laws including but not limited to Prevention of Cruelty to Animals Act, 1960, and allied rules, Transport of Animal Rules, 2001, Wildlife Protection Act 1972 and allied regulations therein are duly adhered to;
  6. in respect of any property, the related laws including but not limited to all tax related laws and regulations are duly adhered to;
  7. every relevant law, rule and regulation in relation therewith and pertaining thereto are duly adhered to;
35. You agree and acknowledge that You are, vis a vis the services offered by you on NOBUY RENT, duly qualified to provide such service, under any and all applicable laws, rules and regulations incidental thereto; and You have not and shall breach any such laws while offering such services on NOBUY RENT.
36. All Vendors are bound by the Privacy Policy of NOBUY RENT and the term "User" in the Privacy Policy shall also indicate Vendor, unless and until such interpretation is not applicable to the Vendor in a specific context, as provided and decided by NOBUY RENT.
37. You agree and acknowledge that any promotion undertaken through any form of advertisement enunciated above or in any other manner by the Vendors, shall be in compliance with the Code for Self-Regulation of Advertising Content, released by the Advertising Standards Council of India, the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022 released by the Central Consumer Protection Authority, and/or other applicable Laws, rules and regulations connected therewith or incidental thereto.
5. Agreement to receive Mails & Phone calls
1. By way of accepting these Conditions You hereby consent to the receipt of communication from us by way of e-mails, newsletters, WhatsApp messages & phone calls and agree to provide necessitated information and feedback required by NOBUY RENT.
6. Term
1. These Conditions shall apply from the date of Your completed registration for or use of NOBUY RENT’s Services, and continue until terminated by NOBUY RENT or You as provided in these Conditions ("Term").
7. Termination
These Conditions shall continue to apply until terminated by either You or Us as set forth below:
1. Termination by You: If You wish to not be bound by these Conditions, You may terminate Your relationship with Us by deleting Your Account and stop accessing and using NOBUY RENT. Please note that deleting Your Account does not delete any or all posts, from Your Account as the said information shall be retained by NOBUY RENT for purposes provided in the Privacy Policy. NOBUY RENT owns the right to store, retain, modify, alter, use, transmit, publish, disseminate, distribute, remove or delete the said contents in manner and purpose, as decided by NOBUY RENT.
2. In the event that You wish to delete Your Account and require assistance in removal of your listings, You may write to us at support@nobuyrent.com.
3. Termination or Restraint by Us: The Company may at its discretion and at any time with or without notice, terminate Your Account or suspend the Conditions, restrain or limit the usage of certain features or services, with or without cause if:
  1. NOBUY RENT is unable to verify or authenticate any information provided by You or
  2. You breach any of the provisions of these Conditions, the Privacy Policy or any other laws, anywhere in the world, that may be applicable to You; or
  3. Company is required to do so in accordance with or in pursuance of Your violation of, applicable Laws; or
  4. NOBUY RENT has reasonable grounds for suspecting any illegal, fraudulent or abusive activity on part of You or on account of any of Your activity suspected to be against the interests of any User or Vendor or NOBUY RENT
  5. Company has elected to discontinue, with or without reason, access to NOBUY RENT (or any part thereof) either in general or specifically to You.
4. Upon the termination of Your Account, You shall immediately return to the Company all the information, documents and materials in Your possession, including but not limited to the items specified under these Conditions, relating to the business or affairs of the Company or of the Users/Vendors or any of its affiliates or associates or branches or clients. You undertake that You shall not retain or disclose or utilise any copies or extracts of the above information, documents or materials therefrom. The Company shall not be liable to You or any other Vendor, User or third party for any such termination.
8. Geographic Limitation:
1. 1. NOBUY RENT may contain links to other websites, software or mobile applications controlled by third parties. You acknowledge that the NOBUY RENT is not responsible for and does not endorse the contents or access or use of these websites or software or mobile applications.
10. Public posts and Rating:
1. You agree to use careful, prudent, and good judgment when leaving feedback or rating regarding NOBUY RENT. In the event that the feedback or rating is inappropriate or violates propriety or privacy of another User, or is in violation of any applicable Laws or NOBUY RENT Policies, the Company, in its sole discretion, may report the same to law enforcement authorities any actions that may be illegal.
2. You agree and acknowledge that NOBUY RENT at its sole discretion may remove any post, feedback or rating.
3. When legally required or at NOBUY RENT’s discretion, the Company may initiate investigation or raise complaints before appropriate forums of alleged illegal activity on NOBUY RENT.
4. Reporting inappropriate use of feedback or rating: You may contact the Grievance Redressal Officer (as provided under the Section 20), regarding any inappropriate use of feedback or rating or other details.
5. NOBUY RENT does not and cannot review every posting made on the NOBUY RENT. These Conditions do not require NOBUY RENT to monitor, police or remove any postings or other information submitted by You or any other User and NOBUY RENT shall not be responsible for any ensuing liability.
11. Intellectual Property Rights:
1. You hereby acknowledge that any and all intellectual property rights (including but not limited to all trademark, copyright, patent, service marks, domain name etc.) and other proprietary rights in and in relation to NOBUY RENT and the contents provided therein, including without limitation any compilation, data, materials, articles, drawings, depictions, explanations, health records, call records, derivatives, improvements or modifications which ownership is directly attributable to the Company (expressly excluding any personal information, intellectual property which belongs to a third party) and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by You or any other Vendor or Users or third parties relating to NOBUY RENT or its service providers shall vest wholly, completely, and fully with the Company throughout the territory of the world and You shall not directly or indirectly infringe Intellectual Property Rights and have no right or claim to the Intellectual Property Rights in any manner whatsoever.
2. NOBUY RENT respects the intellectual property rights of others and expects You to do the same. You agree and acknowledge that You shall not infringe or pass off, directly indirectly, the intellectual property rights of others; and You agree to indemnify NOBUY RENT for any damage that may arise for NOBUY RENT, in the event of any action/claims brought by a Vendor, User or third party against NOBUY RENT in this relation.
3. At NOBUY RENT’s discretion and in appropriate circumstances, NOBUY RENT may remove any content submitted to NOBUY RENT and/or terminate the accounts of Users or prevent access to the NOBUY RENT by Users who infringe the intellectual property rights of others, unless such content/rights of such User is protected by an order of a Court.
4. If You believe that the intellectual property rights in Your work or in the work for which You act as an agent, or that of a third party has been infringed through NOBUY RENT, please contact NOBUY RENT’s representative agent for notice of claims of intellectual property rights infringement, Mr. Sathese Kumar, who can be reached through support@nobuyrent.com. However, You agree and acknowledge that any actions towards the said allegation may be taken by NOBUY RENT at its sole discretion, unless directed or bound by any order of the appropriate courts.
12. Payments:
1. All Your payments on NOBUY RENT are currently processed by Razorpay. Your financial information is stored by Razorpay in compliance with industry standards / recommended data security standards for security of financial information. The privacy policy and security measures of Razorpay can be accessed at https://razorpay.com/privacy/.
2. NOBUY RENT may require the You to make payments with a credit card, wire transfer, debit card or UPI for any purchases made on NOBUY RENT. For processing such payments, Razorpay shall require the You to enter such credit/debit card number and/or other financial institution information such as bank account numbers and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such credit/debit card number and information to third parties as necessary to complete such billing operation. Verification of such information, however, is accomplished solely by You through the authentication process. Your credit card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. You are hereby advised, that internet technology is not full proof safe and that You should exercise discretion on using the same. NOBUY RENT also provides You an option to not save Your payment details, which You are advised to utilise with Your sole discretion. Further, you agree and acknowledge NOBUY RENT shall bear no liability in relation with any data breach of your financial information, caused as a result of the operations of Razorpay or any third parties.
13. Disclaimer of Warranties and Liabilities:
1. You understand and agree that the Company provides NOBUY RENT on an 'as-is' 'with all faults' and 'as available' basis. You agree that use of the NOBUY RENT is at Your risk. All warranties including without limitation to, the implied warranties of merchantability and fitness for a particular purpose for title and non-infringement are disclaimed and excluded.
2. No representations, warranties or guarantees whatsoever are made by the Company as to the
  1. accuracy, adequacy, reliability, completeness, suitability or applicability of the information to a particular situation or in respect of any discloure or non-disclosure of any information by its Users or Vendors;
  2. that the features shall be uninterrupted, timely, secure, or error-free;
  3. the quality of any services, content, information, or other material on the NOBUY RENT shall meet Your expectations or requirements;
  4. any errors in the NOBUY RENT shall be corrected;
  5. warranties against interception or infringement of any User or Vendor or third party intellectual property or proprietary rights; or
  6. other warranties relating to performance, non-performance, or other acts or omissions of the Company, its officers, directors, employees, affiliates, agents, licensors, or suppliers
3. NOBUY RENT does not make any representation or warranty regarding the reliability, accuracy, completeness, correctness, or usefulness of third party content, and disclaims all liabilities arising from or related to third party content inside or outside the NOBUY RENT.
4. You acknowledge and undertake that You are accessing the services of NOBUY RENT and transacting at Your own risk and are using Your best and prudent judgment before entering into any transactions through NOBUY RENT. We shall neither be liable nor responsible for any actions or inactions of Users nor any breach of conditions, representations or warranties by the Users and hereby expressly disclaim any and responsibility and liability in that regard. We shall not mediate or resolve any dispute or disagreement between You and the Users.
5. You agree and acknowledge that NOBUY RENT is merely a marketplace e-commerce platform/facilitator and is not and cannot be a party to or control in any manner any transactions that happen pursuant to the Services. Accordingly, any contract that arises between You and the User shall be a strictly bipartite contract between You and such User. We further expressly disclaim any warranties or representations (express or implied) in respect of quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the products/services listed or displayed or transacted or the content (including product/service or pricing information and/or specifications) on the NOBUY RENT. While we have taken precautions to avoid inaccuracies in the content displayed on NOBUY RENT, all content, information (including the price of products/services), are provided as is, without warranty of any kind. We do not implicitly or explicitly support or endorse the hiring of any products/services on the website. At no time shall any right, title or interest in the products/services offered for rent or displayed on NOBUY RENT vest with NOBUY RENT nor shall NOBUY RENT have any obligations or liabilities in respect of any transactions on the website.
6. NOBUY RENT does not endorse any Vendor/listing. In the event that You have listed a product/service where such listing is misleading, duplicate in nature, insulting or detrimental towards the interest of any User or NOBUY RENT, or in violation of laws of India including but not limited to illegal or prohibited products/services, defective products/deficiency in services provided by You, infringement of intellectual property rights of Users/Vendors/NOBUY RENT/third parties by You, or for any other similar reasons, Users may report You, or the product/service through the “Report” option available below every listing.
7. You agree and acknowledge that no payments to be exchanged between You and the User shall be transacted through NOBUY RENT and any issue faced by a User in relation with the rented product or hired service shall be raised solely with You and any claims for refund/exchange/replacement in respect of the Services shall lie solely against You.
8. NOBUY RENT disclaims any liability towards collection, storage, usage of financial information or collection of payments from the Vendors; You acknowledge and agree that You shall not proceed against or initiate action against NOBUY RENT for any kind of damages whether personal, monetary or reputational etc., caused to You, by other Users, Vendors or any third parties or by Your own negligence in respect of usage of financial information or collection of payments etc., as stated in this clause, under any circumstances whatsoever.
9. The Company does not warrant that any of the softwares used and or licensed in connection with NOBUY RENT shall be compatible with other third party software or Devices nor does it warrant that the operation of NOBUY RENT and the associated software shall not damage or disrupt other software or hardware on Your Devices.
10. Notwithstanding anything contained elsewhere in these Conditions, in no event shall the Company or any of its directors, officers, employees, technicians, agents or content/service providers be liable to You or anyone claiming under You for any costs or loss incurred or suffered by You or anyone claiming under You, including but not limited to any special, exemplary, consequential, incidental, punitive or indirect damages on any theory of liability, whether in contract, tort (including without limitation negligence), strict liability, liability arising in relation to and out of the operations of NOBUY RENT, contents posted, transmitted, exchanged or received or violation of any Intellectual Property Rights or any of the Users’ /Vendors’/third parties’ activities, negligence, inaction or omission or violation of Laws or otherwise. In no event or circumstance shall the Company be under any liability to make good any loss whether by way of any monetary payment or otherwise.
11. The Company or any of its directors, officers, employees, technicians, agents or content/service providers or anyone else involved in administering, distributing or providing the services of NOBUY RENT further explicitly disclaims any and all liability for any mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, computer viruses or other harmful, disabling computer code, computer instructions, circuitry or other technological means whose purpose is to disrupt, damage or interfere with any computer and communications facilities or equipment ("Harmful Code") that may be transferred to Your Devices when accessing the NOBUY RENT. By way of clarification, Harmful Code shall include, without limitation, any code containing viruses, Trojan horses, spiderbots, worms or similar destructive code or code that was intentionally written to self-replicate. You are advised to obtain and use appropriate anti-virus and security software and to take all other appropriate measures to safeguard the integrity of Your Devices.
12. We collect, store, process and use Your information in accordance with Company’s Privacy Policy. By using NOBUY RENT and/ or by providing Your Personal Information (as defined in the Privacy Policy), You consent to the collection and use of the information You disclose to Us, in accordance with the Privacy Policy;
13. To the maximum extent permitted under applicable law, in no event will NOBUY RENT or any of its affiliates have any liability to You or Your affiliates, under any legal or equitable theory, whether in contract, tort (including, without limitation, negligence), product liability, statute or otherwise, for or in connection with these Conditions or with respect to the NOBUY RENT Policies.
14. You agree and acknowledge that NOBUY RENT shall bear no responsibility vis a vis the return of any product taken for rent or acknowledgment of provision of any service, including but not limited to return of products on time, condition/quality of the returned products, time frame for services etc., and any damages connected therewith or incidental thereto.
14. Indemnification:
1. a.Notwithstanding anything provided under these Conditions or under NOBUY RENT Policies, You agree that You shall defend, indemnify and hold the Company, its directors, shareholders, officers, technicians, other content/service providers and other representatives harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with:
  1. Your access to NOBUY RENT,
  2. Your use of the services/features/facilities of NOBUY RENT, or
  3. Your violation or breach of NOBUY RENT Policies or any applicable Laws;
  4. Your violation of any Intellectual Property Rights of any other Vendor, User or third party; or
  5. Your misrepresentation, negligence, fraudulent or criminal activities in connection with the usage of NOBUY RENT
  6. any and all third-party claims based upon the content of any communications transmitted by You.
2. Not withstanding anything provided under these Conditions or under NOBUY RENT Policies, You agree that You shall not commence, maintain, initiate, or prosecute, or cause, encourage, assist, volunteer, advise or cooperate with any other person to commence, maintain, initiate or prosecute, any action, lawsuit, proceeding, charge, petition, complaint or claim before any court, agency or tribunal against NOBUY RENT or any of the other matters discharged and released in these Conditions. You also agree that if You, or someone acting on Your behalf, should file, or cause to be filed, any such claim, charge, complaint, or action against NOBUY RENT, You expressly waive any and all rights to recover any damages or other relief from NOBUY RENT including, without limitation, costs and attorneys’ fees.
15. Confidentiality:
1. Each Party may disclose to the other such Confidential Information as may be necessary to further the performance of these Conditions.
2. The Vendor undertakes to the Company:
  1. to keep confidential the Company’s Confidential Information;
  2. that it shall not disclose the Confidential Information in whole or in part to any other person without the Company’s prior written consent, except to the Vendor’s employees, agents and subcontractors involved in the performance of these Conditions on a confidential and need to know basis and provided that employees, agents and sub-contractors are bound by written agreements of confidentiality which are at least as stringent as the provisions of these Conditions;
  3. to use the Confidential Information solely in connection with the performance of these Conditions or obligations under NOBUY RENT Policies;
  4. to not use any Confidential Information or any information related to the relationship between the parties herein for any purpose other than performance of obligations under under NOBUY RENT Policies and
  5. and take all due efforts to protect the Confidential Information of the Company.
3. Upon request by the Company, the Vendor must deliver to the Company all documents and other materials in any medium in its possession or control which contain or refer to the Company’s Confidential Information. If the documents or other materials are not capable of being returned, the Vendor must destroy and certify the destruction of such documents and materials to the reasonable satisfaction of the Company after obtaining prior consent from the Company.
4. Your personal/sensitive personal data/information shall be governed by the Privacy Policy of the NOBUY RENT, which terms (including all amendments, modifications, reinstatements and substitutions) shall be deemed to be incorporated herein by way of reference.
16. Limitation of Liability:
1. It is expressly agreed by You that:
  1. NOBUY RENT shall under no circumstances be liable or responsible for any loss, injury or damage to You, the User or any other party whomsoever, arising on account of any activity concerned with these Conditions, transaction between You and a User, or as a result of the products/services being in any way damaged, defective, deficient, in an unfit condition, infringing/ violating any laws/ regulations/ intellectual property rights of any third party.
  2. NOBUY RENT shall not be liable for any fake, inactive, innaccurate, fraudulent, misleading, impersonating, non-existing Accounts created by Users or other Vendors.
2. You shall be solely liable for any claims, damages, allegations arising out of the products/services offered for rent through the NOBUY RENT website or app (including but not limited to quality, quantity, price, merchantability, use for a particular purpose, or any other related claim) and shall hold NOBUY RENT harmless and indemnified against all such claims and damages.
3. Further NOBUY RENT shall not be liable for any claims, damages arising out of any negligence, misconduct or misrepresentation by You or any of Your representatives.
4. NOBUY RENT under no circumstances will be liable to You for loss and/or anticipated loss of profits, or for any direct or indirect, incidental, consequential, special or exemplary damages arising from the subject matter of these Conditions, regardless of the type of claim and even if You have been advised of the possibility of such damages, such as but not limited to loss of revenue or anticipated profits or loss in business.
17. Modifications:
1. We may amend any of the terms and conditions contained in these Conditions at any time and at Our sole discretion. Any changes will be effective upon the notification of such changes to You, and You are responsible for reviewing the same and informing Yourself of all applicable changes or notices.
2. You agree and acknowledge that You shall keep track of such changes and review the Conditions so as to comply with the same.
3. Your continued use of the Service after NOBUY RENT's posting of any changes will constitute Your acceptance of such changes or modifications.
18. General:
1. To the extent that anything in or associated with NOBUY RENT is in conflict or inconsistent with these Conditions, these Conditions shall take precedence and prevail. Our failure to enforce any provision of these Conditions shall not be deemed a waiver of such provision nor of the right to enforce such provision. Our rights under these Conditions shall survive any discontinuance of the access or use of NOBUY RENT.
2. If any provision of these Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
3. Any notices to You from the Company regarding NOBUY RENT or these Conditions shall be posted on NOBUY RENT or sent to You through Your registered e-mail or phone number.
4. You agree that the relationship between You and NOBUY RENT is of an independent contractual nature, and nothing in these Conditions will create any partnership, joint venture, agency, franchise, sales representation, or employment relationship between us. You will have no authority to make or accept any offers or representations on Our behalf.
5. Nothing expressed or mentioned in or implied from these Conditions is intended or will be construed to give to any person other than the Vendors to these Conditions any legal or equitable right, remedy, or claim under or in respect to these Conditions. These Conditions and all of the representations, warranties, covenants, conditions, and provisions in these Conditions are intended to be and are for the sole and exclusive benefit of NOBUY RENT, You, and the Users of NOBUY RENT.
6. Governing Law: These Conditions shall be governed and construed under the laws of India, without any reference to its conflict of law rules and the courts of Coimbatore, Tamil Nadu shall have exclusive jurisdiction. In case of any disputes or differences between the You and NOBUY RENT, the same shall be resolved by Conciliation under Arbitration and Conciliation Act, 1996. If the said disputes or differences are not settled by Conciliation, the parties shall resolve them by Arbitration under Arbitration and Conciliation Act, 1996. The seat of arbitration shall be at Coimbatore, Tami lNadu and the language of arbitration shall be English.
19. Force Majeure:
1. The failure or delay of NOBUY RENT hereto to perform any obligation under these Conditions solely by reason of acts of God, acts of government, riots, wars, embargoes, pandemics, strikes, compulsory lockdown, pandemics, accidents in transportation, or other causes beyond the control (all the above eventualities hereinafter collectively referred to as “Force majeure”) occurring at or affecting the place or premises of discharging its obligations, shall not be deemed to be a breach of these Conditions till such time as the force majeure continues.
